Krzysztof Łyszyk and his team advised Mr. Mikołaj Nawacki and Glastonbury Ventures Limited in the sale of a controlling stake in Calypso Fitness S.A. to Benefit Systems S.A. Calypso Fitness is an operator of the biggest fitness clubs network in Poland. Completion of the transaction is subject to the approval by the President of Office of Competition and Consumer Protection. On 26-27 September 2016, KKLW participated in the annual Property Forum. The main issues raised during the conference were new REIT regulations, new possibilities arising out of the Brexit and alternative investments.

On 21-22 September 2016, KKLW participated in the Shopping Center Forum. The autumn edition of this event mainly concentrated on the most important challenges arising in the development of shopping centers, e.g. matters regarding investments financing.
Jacek Kosiński at a conference on construction investments
Jacek Kosinski participated as a speaker at conference “The Problematic aspects of construction investment processes”. Conference was held at the Sheraton Hotel in Warsaw, on 12-13 September 2016. The main issues that were discussed during the conference covered: problems of a newly-adopted construction law, dangers for the future of construction investments, and important issues regarding construction contracts.

KKLW represents a consortium of companies in a dispute with the contractor works
Our team led by lawyer Jack Kosinski successfully represented the consortium in a dispute with the contractor works. These included the supply and installation of specialized systems and software control.
The dispute concerned the improper performance of work, faulty transfer of copyrights, licenses and authorization for further modifications to control systems. Importantly, the dispute appeared issues failure by the contractor sufficient human resources at the specialized personnel. Consistently one of the claims involved amounts paid to the contractor substitute. Originally, the claims were asserted in the judicial process. In the course of negotiations we have been undertaken, which led to the conclusion of a detailed and multifaceted settlement. The total value of the claims of the parties in the Agreement exceed the sum of 40 million.
